Jason and Pete from Motorhome Diaries have been detained at the Canadian border leaving Vermont on I-91. They have been there for the last 4 hours, MARV has been searched by both state agents and the K-9 patrol. The MHD Guys were filming as the neared the check point, but the video was deleted and they were informed if they continued to film, record, or take pictures they would be arrested.
A box of literature from the Alliance of the Libertarian Left was taken, and a copy of Crispin Sartwell’s “Against the State” was left out on the counter. The RV was ransacked but thankfully not to the point it was in Jones County, Mississippi. Their laptops are now in the possession of the state agents, and those agents are reading about fr33 Agents, The Free State Project, and Jason & Pete’s former employer. One agent has accused them of ’spreading misinformation.’
The guys have been told that the state agents are looking for “Pornography or Heinous Propaganda.” When asked for a definition of “Heinous Propaganda” or the applicable statute they were told it was available online, but they don’t have computers or Internet access.
The agent that is holding them hostage is Agent number 17258, and his supervisor, Miguel Begin (sp?) can be reached at 819.876.7821 x112. Stay Tuned for further updates.
Update: Jason and Pete have been denied entry into Canada, citing the Jones County incident. Now waiting to go back through US Border patrol.
Update 2: Computers were kept as possible evidence of Propaganda.
Update 3: Computers returned, State Agents still in posession of box of ALL Literature.

So, Canada doesn’t want crime victims to enter the country? Are they afraid you’re going to ask for asylum or something?
Interesting that they cite the Jones County arrest, which hasn’t even gone to trial yet, and has resulted in no conviction yet. I guess you really ARE guilty until proven innocent :/
That was the canadian side of the line, and now let’s see what the u.s. side can drum up.

Xaq, thanks so much for getting this out. After being held/detained/not-free-to-go for 4+hrs Jason and I were ultimately refused entry into Canada and after turning around had to sit at the united states border checkpoint for 30min+.

I know it’s a scrap – but it sounds similar to what US law refers to as “hate speech”.
Personally – I think this is the US DHS somehow tipping off the Canadians about MARV’s approach and having the Canadians do the “dirty work”.

One amusing thing that comes out of this — if you’re curious about the exact definition of “heinous propaganda” and google that term, you’ll find that four out of the top ten search results, including the first result, are already about today’s incident.
Could that mean that they don’t use it very much? It’s sorta their “secret charge?”
Anyway, does the ACLU take cases pertaining to Canada? If not I would think that the Fraser Institute or some Canadian ally of ours would know a good civil rights lawyer.

What I don’t get is why did the Canadian’s border bureaucrats have the legal authority to search the laptops and video camera…especially erasing the recording on the video camera? By trying to enter their country are you automatically giving up all your rights to private property, wherein they can alter and change your private property at their own will?

The US isn’t much better…
When crossing the border into the US the state agents claim a right to search, seize, or copy all the data on your laptop, desktop, any printed or digital materials, CDs, DVDs, Flash Drives, thumb drives, punch cards, floppy disc, data tapes, ipod, etc. The Data can be shared with any number of federal and state agencies, or even private companies for decryption and translation. The have upheld this policy, ruling that an in-depth analysis of a laptop’s hard drive using the EnCase forensics software “was permissible without probable cause or a warrant under the border search doctrine.”
Even if you are far enough away from the border to bot be in a where a warrant or probable cause, the 5th amendment does not protect your , you can be forced to either enter it yourself, provide unencrypted copies, or give the state agents your password.
There are some options to help protect your data, if not your devices, when crossing the border. None of these will keep them from taking your machine until they crack it, give up, or get tired of waiting. Bruce Schneier published an article last week titled , and another one . Following his most recent articles advice offers security and some legal protection, as YOU don’t know the password, so it is impossible to surrender it anyway. There is a slightly older article over on CNET titled that still has some really good advice, including some of the tools I use regularly. Some other options are storing everything important online, and re-downloading when you reach your destination; or, mailing your laptop to your hotel.
